A sipgate team account Administrator must read and agree to the "Terms of Service: UK and EU Call Packages for sipgate team" prior to booking the sipgate team Pro Package via the sipgate team account's online "Plans & Locations" settings.

 

Terms of Service: UK and EU Call Packages for sipgate team

Service specification sipgate team call packages

 

This sipgate team call packages service specification stipulates the terms of use of the sipgate services described herein. Insofar as the customer is required to pay a fee for the following services, this is indicated in the company’s current price list. A link to the respective current price list is provided at the end of this document. sipgate’s general terms and conditions and service specifications to which the customer has already agreed by ordering other products apply in addition.

Tariff option: sipgate team call package

1. Basic team contract

A sipgate team call package contract (hereinafter referred to as a “team call package” or “call package”) may only be ordered as an additional option for a relevant sipgate team contract (e.g. team UK & Europe Call Package 5 for a team 5 contract).

2. Scope of the respective call package

2.1. sipgate team UK & Europe Call Package

In return for payment of the monthly basic fee indicated in the price list, a sipgate team UK & Europe Call Package contract enables the customer to make voice calls and send faxes free-of-charge from all of its VoIP and fax extensions to any fixed and mobile telephone networks within the EU’s member states as well as any fixed and mobile telephone networks in Switzerland.

The UK & Europe Call Package covers the following countries: Belgium, Bulgaria, Denmark, Germany, Estonia, Finland, France, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Austria, Poland, Portugal, Romania, Sweden, Switzerland, Slovakia, Slovenia, Spain, Czech Republic, Hungary, United Kingdom and Cyprus.

2.2. sipgate team UK Call Package

In return for payment of a monthly basic fee indicated at http://www.live.sipgate.co.uk/team/plans, a sipgate team UK Call Package contract enables the customer to make voice calls and send faxes to the United Kingdom’s landline and mobile networks. This call package covers any voice calls made and faxes sent to the United Kingdom’s fixed and mobile networks using any VoIP and fax extensions available under the customer’s basic contract.

2.3. Connections not included

This does not cover connections established from SIM extensions (mobile end-points).

Unless expressly stipulated otherwise in the specification for the respective call package (see Item 2.1), telephone calls to foreign fixed or mobile telephone networks are not included in the call package and will be billed separately at the rates indicated at http://www.live.sipgate.co.uk/team/plans.

However, the call package only covers connections made between two human beings. It does not cover connections enabling communication between machines. This does not include connections established for the purpose of sending faxes.

sipgate continues to reserve the right to block connections to certain destinations if it is not possible to purchase the required connection services economically.

Telephone calls made to phone numbers with these (excluded) area codes will be billed at the rates indicated in the applicable price list.

2.4. In case of call package voice tariffs, itemised billing is not available for connections covered by a call package.
2.5. The call package does not cover outgoing calls made through call transfer/call forwarding options.
2.6. Change of contract (upgrade/downgrade)

If a customer orders a more extensive call package option during the term of an existing team call package contract which includes this existing call package (upgrade) or this customer orders a call package contract for other voice services, in addition to its existing contract, this order will be immediately effective. The customer will be billed for these call packages pro rata temporis for the respective calendar month. Any amounts already paid will not be reimbursed.

If the customer orders a call package option during the term of an existing call package contract which only includes some of the services featured in its previously ordered call package option (downgrade), this order will only become effective upon expiry of the current month.

3. End-customer usage

3.1. The customer undertakes only to use the sipgate team call package as an end-customer, for a normal usage volume, and, in particular, not to use it to establish connections which are maintained without any interruption or virtually without any interruption. Usage by third parties not belonging to the customer’s company is excluded.

3.2. A precondition for billing within the team call package tariff is that the customer may not be a provider of telecommunications services, value-added services or individual mass communication services. In particular, the customer may not be a provider of fax broadcast services or call centre or telephone marketing services or use the team call package tariff for these forms of mass communication.

3.3. The team call package does not cover connections which the caller establishes in order to provide telecommunications services for third parties or which it passes on to third parties against payment or in return for other advantages.

3.4. Nor does the call package cover connections which are not made to establish direct voice or fax connections with other users, in particular, connections which the customer establishes in order to obtain access to the internet or which are made for dial-in purposes. This also excludes connections established by means of the “Callback”, “Conference”, “Call transfer” or “Call forwarding” functions.

Finally, nor does the team call package cover connections which are made in order for the customer or a third party to realise financial benefits on the basis of the duration of the connection; this includes calls to advertising hotlines.

4. Limitation of number of simultaneous connections

Use of the sipgate team call package is restricted to a specific number of simultaneous sipgate lines. The number of simultaneous lines is in accordance with the customer’s sipgate team contract (e.g. in case of a sipgate team 5 contract, 5 simultaneous lines will be available). Connections exceeding this restriction will not be provided as part of the sipgate team call package. Simultaneous calls to destinations which are not offered free-of-charge as part of the sipgate team call package are not restricted and will be billed at the rates indicated in http://www.live.sipgate.co.uk/team/tariffs.

Use of an external telephone system for the team call package product is excluded.

5. Exclusion of premium-rate numbers and services, separate billing

The customer may not establish any connections to premium-rate numbers or geographic (fixed network) numbers offering premium-rate services (in particular, automated announcements and services; chat or conference services; services offering payment to the sipgate customer or to third parties for the call made, in particular advertising hotlines or top-up services; data, online and internet connections; call forwarding or transfers or similar services). Such connections constitute usage in breach of the customer’s sipgate team call package contract. sipgate reserves the right to claim compensation and to block numbers establishing such connections.

Connections which are established as outlined in the above paragraph, in breach of contract, and connections within the meaning of number 3 of this service specification will be billed at the rates specified in sipgate’s regular standard tariff. Connections which the customer establishes in order to make these available to third parties – either in return for payment or free-of-charge – or which it passes on to third parties and connections which are established by means of the call transfer/callback or conference functions will likewise be billed at the rates for the customer’s selected sipgate tariff rather than the rates for sipgate’s team call package.

6. Term, regular and extraordinary termination

The sipgate team call package contract has a term of one month. Upon expiry of its minimum term, the contract will be extended by one month at a time unless terminated.

Should sipgate terminate the sipgate team call package contract, the customer will likewise be entitled to do so.

The team call package contract will automatically end upon termination of the customer’s team basic contract.

The customer may regularly terminate its sipgate team call package contract at any time, at the end of a month, subject to a notice period of one working day (i.e. a full working day is required between notice of termination and the date on which termination is to become effective). Termination must be declared in writing (e.g. by e-mail).

sipgate is entitled to require proof of the identity/legitimacy of the person providing notice of termination.

In case of a reasonable assumption on the part of sipgate that the customer’s use of the service entails a breach of contract (nos. 3-5), sipgate shall have an extraordinary right of termination for the tariff option or for the contract as a whole. In case of its extraordinary termination of the sipgate team call package tariff option, sipgate will bill the customer for future services on the basis of its tariff list.

sipgate expressly reserves the right to claim compensation from the customer for its use of its sipgate connection in breach of this contract.
